I shouldn't have thought so, as it even says it includes recordings released elsewhere legally (Hostage etc). I suppose its up to whoever owns copyright on the recording to complain.

It's not legal, and it's against eBay's rules. I used to send reports of these kind of things to eBay, but they didn't often amount to anything. Maybe I can dig up that report link again, and if a few people report these they'll take them down. Though there are a lot of these kind of auctions...
